• Case Evaluation Summary Guidelines

Effective April 1, 2021 summaries served on the ADR clerk can no longer be sent through MiFile e-service and instead must be emailed to ADR@oakgov.com. Please refer to your Case Evaluation Notice and Summary Guidelines for further instructions. Case Evaluators will access their summaries through a SharePoint folder shared by the ADR clerk. Parties may continue to e-serve summaries through MiFILE on parties listed as service contacts or serve pursuant to MCR 2.107. To avoid a late fee, summaries must be served by 4:30 p.m. 7 days in advance of your hearing date.

Case evaluation and adjournment fees are collected by the Case Evaluation Department. The Case Evaluation Department actively collects late fees and penalties. Checks should be made payable to Circuit Court Case Evaluation and forwarded to:

Orders for adjournment of mediation or case evaluation must address several issues:

• A specific date cannot be put into the order. If the parties need a specific date, they may include language in their order indicating which week or two of the month they prefer - not a specific day.
• Costs related to a late adjournment must be addressed in the adjournment order. If costs are to be waived or paid by one party, the order of adjournment must be specifically state so.

No. Effective April 1st, 2021, at least 7 days before the hearing, each party shall email their case evaluation summaries to the ADR clerk at adr@oakgov.com.

The case evaluation fee is $75.00, made payable to Oakland County Case Evaluation.

The late fee is $150.00 for filing late summaries. This includes any document filed after the 7 day filing deadline. Filing a summary within 24 hrs of the case evaluation hearing subjects the attorney or party to an additional $150 penalty (MCR 2.403(I)(2)).

Per MCR 2.403(G)(2), adjournments may be granted only for good cause. Contact the clerk to the assigned judge for further information.

Summaries are not kept by the Case Evaluation office and therefore must be refiled at least 7 days prior to the new case evaluation date.
