The Family Division of the Circuit Court was created by Public Act 388 of 1996. Effective on January 1, 1998, all family matters previously handled by the Circuit and Probate Courts in Oakland County became consolidated under the new Family Division of the Circuit Court, creating one place where a family could go with all of its legal issues.

The Family Court Plan outlined in Administrative Order 2020-02J currently governs the operations of the Family Division. Cases involving a family are assigned to judicial teams consisting of the judge, referees, case assistants, and family counselors. The Family Division is comprised of Circuit Judges.
