2024 Tax Foreclosure Claims Process

After foreclosure, the Oakland County Treasurer's Office mailed notices to the 2024 foreclosed property owners with the required form and submission instructions.

A person that intends to make a claim for excess sale proceeds must complete and return a notarized Form 5743 Notice of Intention to Claim Interest in Foreclosure Sales Proceeds. The form must be received at the Oakland County Treasurer's Office by July 1, 2024.

Per Michigan law, claim forms postmarked by July 1, 2024, but not received at the Oakland County Treasurer's Office will not be processed.

Claim Eligibility

A residential or commercial property owner who held a title or equity interest at the time of foreclosure may file a claim to receive excess sales proceeds associated with the property.

Key Dates

The key dates are below.

April 2, 2024 Property Foreclosed
July 1, 2024 Notarized Form 5743 must be received by the Oakland County Treasurer's Office.
August 2024 Property may be sold at land sale auction.
October 2024 Property may be sold at the second land sale auction.
January 2025 Oakland County Treasurer's Office will notify claimants by U.S. mail of the sale amount, other claims filed and will provide legal aid resources for help with the claims process.
February 1 – May 15, 2025 Following receipt of the Oakland County Treasurer's notification, a claimant must file a motion with the Sixth Circuit Court in Oakland County for a hearing to determine the claim payment.
